Terms of Service

These Terms of Service ("Terms") govern your use of the Thrivesu platform, including our website, dashboard, and APIs (collectively, the "Service"), operated by Thrivesu ("we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and have the authority to enter into a legally binding agreement on behalf of yourself or the business you represent. By accepting these Terms, you represent that all information you provide is accurate and complete.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscription Plans & Billing
Thrivesu offers a Free tier and paid subscription plans (Basic, Pro, Premium). Paid plans are billed monthly or annually in advance. Prices are listed in USD and subject to change with 30 days' notice.
- All new accounts begin with a 14-day free trial on the Pro plan.
- You may cancel at any time; your subscription remains active until the end of the current billing period.
- Refunds are not provided for unused portions of a billing period, except where required by applicable law.
- We use Stripe to process payments. By subscribing you agree to Stripe's terms at stripe.com/legal.
4. Acceptable Use
You agree not to:
- Use the Service to transmit spam, malware, or illegal content.
- Reverse-engineer, decompile, or extract source code from the Service.
- Attempt to circumvent rate limits, access controls, or security measures.
- Use the Service in a way that infringes third-party intellectual property rights.
- Violate Meta, Google, or other platform policies when using their respective integrations through Thrivesu.
5. Integrations & Third-Party Services
Thrivesu connects to third-party services including Google, Meta (WhatsApp, Instagram, Facebook), and Stripe. Your use of those integrations is also governed by the respective platform's terms and privacy policies. We are not responsible for changes to third-party APIs that affect Service functionality.
6. Data & Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service you consent to our data practices as described there.
7. Intellectual Property
The Service, including all software, graphics, and content, is owned by Thrivesu or its licensors and protected by intellectual property laws. You retain ownership of your data. You grant us a limited license to process your data solely to provide the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIVESU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Changes to Terms
We may update these Terms at any time. We will notify you via email or an in-app notice at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Brazil without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of São Paulo, Brazil.
